If you have been injured at work and desire that Illinois workers compensation should protect you, you should do the following:
  1. Seek immediate medical attention! If your doctor prescribes any work restrictions you should obtain them in writing, provide a copy to your employer, and keep a copy for yourself. Anything concerning your injury should be documented so it can be made available to the Illinois workers compensation officials.

  2. Report your injury to your employer. This can be done by telling your supervisor, or other person in charge. Also, if you cannot find your supervisor or other person in charge, you can report your injury by telling a supervisor, boss, or someone in the Human Resources Department of your company. Make sure you write down the name of the person you told, the date and time you told them and what you may have told them about your injury. Illinois worker comp will want to know this information. Your employer should provide you with an Illinois worker comp claim form (Form 45). If they do not voluntarily give you a form, you should ask for one. Fill out the form and hand deliver it to your employer as soon as possible. If you cannot hand deliver it, you should send it by certified mail. Make sure to keep a copy for yourself. If you retain an Illinois, Wheaton, or Chicago workers comp attorney, make all the paperwork available to him or her.

  3. Seek the advice of an experienced Illinois worker compensation lawyer. Remember, not all attorneys know how to handle an Illinois workers compensation claim. Finding the right Illinois worker compensation lawyer will be important to you in obtaining all that you are entitled to.
